Participant Agreement, Terms & Conditions

In regard to the services of Aerial Dance Chicago, their officers, employees, volunteers, participants and all other persons/organizations acting in any capacity on their behalf (which we will now collectively refer to as “ADC”), I hereby agree to release, indemnify, and discharge ADC, on behalf of myself and/or my children as follows:

 I acknowledge that my participation in ADC activities entails unanticipated risks that could result in physical or emotional injury, including severe injury, paralysis and death. I understand that such risks cannot be eliminated without compromising the essential qualities of the activity. My participation in this activity is purely voluntary, and I elect to participate despite the risks. I understand that I must judge my own capabilities in regard to these activities and agree to act within the limits of my own body. I take full responsibility for my judgments and agree to act with safety as the number one priority.

 I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless ADC from any and all claims, demands or causes of action, which are in any way connected with my participation in this activity or my use of ADC’s equipment or facilities. Should ADC or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. By signing this document, I acknowledge that if anyone is hurt during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against ADC on the basis of any claim from which I have released them herein.

Aerial Apparatus Disclaimer: I acknowledge the use of aerial apparatus is, by nature dangerous. I assume all risks and accept full responsibility for any and all damages and injury of any kind, including death, which may result from the use or misuse of aerial apparatus products. I agree to take full responsibility for obtaining proper maintenance and inspections of the apparatus. I realize that I am responsible for engaging competent riggers to assemble and install the apparatus in all instances where I used the apparatus outside ADC’s studio. I understand that if I use the aerial apparatus at other locations, ADC does not provide rigging services and ADC takes no role in these activities and takes no role in the ways in which the apparatus will be rigged and used. ADC hereby disclaims any and all responsibility for use of the apparatus purchased.

 Photo/Video Release: I understand that ADC intends to document classes and activities through photo and video. By signing I authorize ADC to photograph and video activities and use these images and videos for documentation and promotional purposes. I understand that I will not receive compensation of any type for these images/videos and I understand that their purpose is to generate support for these unique activities by showing the community and funders the scope of the endeavors of the organization.

COVID-19 Disclaimer: I acknowledge there is an inherent risk of exposure to COVID-19 in any public place where people are present. COVID-19 is a highly contagious disease that can cause severe illness and death. By attending programs at Aerial Dance Chicago, I voluntarily assume all risks related to exposure to COVID-19.
